Please read these Terms of Service (the “Terms”) before using MyHeatSheet. They limit our liability to you and set out what you are responsible for.
MyHeatSheet (myheatsheet.com, together with all related websites, applications, content, and services, the “Service”) is owned and operated by Freo Ventures LLC, a Florida limited liability company (“we,” “us,” or “our”). These Terms are an agreement between you and Freo Ventures LLC.
Your agreement is with the company only. No member, manager, owner, officer, employee, or contractor of Freo Ventures LLC is personally a party to these Terms or personally liable under them, and you agree to bring any claim relating to the Service against the company alone.
By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a team, league, club, or other organization, you represent that you are authorized to accept these Terms on its behalf.
The Service provides tools and information relating to swim meets and the teams, leagues, and families that take part in them. Its features change over time: we add, change, and remove functionality at our discretion, and we may introduce entirely new features, sections, or products.
These Terms apply to the Service as it exists today and to every feature we add later, whether or not it resembles what the Service does now. Nothing in these Terms obligates us to provide, maintain, or continue any particular feature.
You must be at least 18 years old to submit content, register, or otherwise transact with the Service. Anyone may browse it, but if you are under 18 you should do so with a parent or guardian’s involvement.
If we offer accounts or logins, you agree to provide accurate information, to keep your credentials confidential, and to be responsible for everything done through your account. Tell us promptly at legal@myheatsheet.com if you believe your account has been used without your permission. We may suspend or terminate any account at any time, with or without notice or cause.
Much of the Service is public. Content submitted to it — including heat sheets and the information extracted from them, meet, team, and league details, links, and images — may be published on the Service, viewed by anyone, indexed by search engines, and copied or redistributed by third parties beyond our control.
Do not submit anything you are not willing to make public. We may in future offer features that limit who can see certain content, but unless we clearly say otherwise, assume that what you submit is public and will stay reachable once it has been.
You are solely responsible for everything you submit to the Service. By submitting it, you represent and warrant, each time you submit, that:
These representations are important to us and we rely on them. If you cannot make all of them about something, do not submit it.
You keep ownership of what you submit. You grant Freo Ventures LLC a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable, sublicensable license to host, store, copy, process, analyze, reformat, adapt, publish, display, and distribute it, and to create derivative works of it, in order to operate, improve, develop, and promote the Service. This license survives removal of the content as to copies retained in backups, caches, logs, or derived data.
We have no obligation to store, retain, monitor, review, or make available any content, and we may remove, restrict, or delete anything at any time, for any reason or none, without notice — including content that is lawful and accurate.
We make no claim or promise that any information on the Service is accurate, complete, current, or reliable, and you should not rely on it. This applies to everything the Service displays, however it got there: information submitted by other users, information extracted or derived from uploaded documents by automated means, information we generate or compile ourselves, and information supplied by third parties.
Automated processing in particular is imperfect. Source documents vary in format, get revised after publication, and are sometimes wrong to begin with, and any schedule, assignment, name, age, time, result, or other detail shown on the Service may be incomplete, out of date, or simply incorrect.
Always confirm anything that matters against the official source and with the responsible organization or officials. You are responsible for your own decisions and for getting yourself and your swimmers to the right place at the right time. We are not responsible for missed events, heats, or sessions, wrong assignments, disqualifications, travel or expense, or any other consequence of relying on the Service.

We may investigate, remove content, and suspend or block access at any time, and may report conduct we believe to be unlawful to the appropriate authorities.
If you want something taken down from the Service — a document, a name, an image, or anything else — email legal@myheatsheet.com with a link to it and what you would like removed. We honor reasonable requests.
At the request of a parent or legal guardian, or of the responsible team, league, or meet host, and without requiring a reason, we will take down information about a person under 18.
If you believe material on the Service infringes your copyright, send a notice to our designated agent at legal@myheatsheet.com that identifies the copyrighted work, identifies the material you say is infringing and its location on the Service, gives your name, address, and contact information, and includes statements that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law, and that the information in your notice is accurate and — under penalty of perjury — that you are authorized to act on the copyright owner’s behalf. Your notice must be signed physically or electronically.

We will remove or disable access to material as appropriate on receiving a valid notice, and we may forward your notice to the person who submitted the material, who may send a counter notification. We terminate the access of repeat infringers in appropriate circumstances. Do not send a notice in bad faith — misrepresenting that material is infringing can make you liable for damages.
MyHeatSheet is independent. It is not affiliated with, endorsed by, or sponsored by USA Swimming, any swim league, team, club, or meet host, or any vendor whose software, formats, or documents it works with. Names, marks, and logos belonging to others appear only to identify them and remain the property of their owners.
The Service may link to or incorporate third-party sites, content, or services. We do not control them, do not endorse them, and are not responsible for them; your use of them is governed by their own terms.
When you give us an email address or other contact details, you agree that we may contact you about the Service — including messages about content you submitted, service and security notices, responses to your requests, and information about features, changes, and offerings that may interest you. You can opt out of non-essential messages using the unsubscribe link in them or by emailing legal@myheatsheet.com. We may still send you messages necessary to operate the Service or required by law.
The Service is currently offered free of charge. We may introduce paid features, subscriptions, or other charges in the future. If we do, we will describe the price and terms before you are charged, and you will never be billed for something you have not agreed to pay for.
We may change, suspend, limit, or discontinue the Service or any part of it, and may remove or delete any content or account, at any time and without notice or liability. We do not promise that the Service will be available, uninterrupted, or preserved, and we may lose or delete content. Keep your own copies of anything you care about. You may stop using the Service at any time.
The Service and all content on it are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that any information on or obtained through the Service is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the maximum extent permitted by law, Freo Ventures LLC and its members, managers, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost data, loss of goodwill, personal injury, emotional distress, or missed events or opportunities, arising out of or relating to the Service, any content on it, or these Terms, whether based in contract, tort, negligence, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.
Our total liability for all claims relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid us in the twelve months before the claim arose and (b) one hundred U.S. dollars ($100).
These limitations are a fundamental part of the agreement between us and apply even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You will defend, indemnify, and hold harmless Freo Ventures LLC and its members, managers, officers, employees, contractors, and agents from and against any claims, demands, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or relating to content you submit, your use of the Service, your breach of these Terms, or your violation of any law or of anyone’s rights — including any claim that content you submitted was published without a required permission or consent.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.
Talk to us first. Before filing anything, email legal@myheatsheet.com describing the problem and give us 30 days to resolve it.
Any dispute not resolved that way must be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue there. To the extent permitted by law, you and Freo Ventures LLC each waive any right to a jury trial and agree that claims may be brought only individually, and not as a plaintiff or class member in any class, collective, or representative proceeding. Any claim relating to the Service must be filed within one year after it arises, or it is permanently barred.
We may update these Terms from time to time, including as the Service changes. When we do, we will change the “last updated” date above. Continuing to use the Service after a change takes effect means you accept the updated Terms.
These Terms and the Privacy Policy are the entire agreement between you and Freo Ventures LLC regarding the Service and supersede any prior understanding. If a provision is found unenforceable, it is limited or severed to the minimum extent necessary and the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them freely, including to a successor in a merger, acquisition, or sale of assets. Nothing here creates a partnership, employment, or agency relationship. Sections 5 through 7 and 15 through 18, and any other provision that by its nature should survive, survive termination of your use of the Service.
